Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LocalsOnDemandplatform, available at localsondemand.me and its related applications (collectively, the "Platform").LocalsOnDemandis operated as an online marketplace connecting clients ("Clients") with independent service providers ("Providers") in Montenegro.

By creating an account or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

LocalsOnDemand acts solely as a technical intermediary. We are not an employer, recruitment agency, or co-provider of any service. Our role is limited to providing the technology that connects Clients with independent Providers.

All service agreements are concluded directly and exclusively between the Client and the Provider.LocalsOnDemand is not a party to those agreements and assumes no contractual obligations arising from them. Providers operate as independent professionals and are solely responsible for the services they deliver, including compliance with applicable professional, tax, and insurance obligations.

No employment, agency, partnership, or joint-venture relationship is created between LocalsOnDemandand any Provider by virtue of registration on the Platform or acceptance of bookings.

You must be at least 18 years of age to use the Platform. By accepting these Terms, you represent that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding contract under the laws of Montenegro or your country of residence.
• All information you provide is accurate and complete.

You must create an account to book services or list as a Provider. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@localsondemand.me if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or otherwise harm other users or the Platform.

All Providers must complete an identity verification process before accepting bookings. This process includes submission of a government-issued identity document (passport or national ID) and a live selfie, which is compared using automated facial recognition technology (AWS Rekognition). A verification score of 90% or above is required for approval.

Scope of verification:The biometric verification process confirms only that the person completing the verification matches the identity document submitted at that time. It does not constitute a guarantee, endorsement, or warranty of any kind regarding a Provider's professional qualifications, skills, competence, character, conduct, or fitness for any particular service or task.

Clients are solely responsible for satisfying themselves as to a Provider's suitability before confirming a booking. LocalsOnDemand reserves the right to reject or revoke Provider status at any time if verification standards are not met or if fraudulent documents are detected.

Booking request: Clients submit a booking request by selecting a Provider, choosing a date and service, and paying the required amount through the Platform.

Payment methods: The Platform accepts online card payments via Stripe and cash arrangements. For cash bookings, a platform commission (€10 flat fee, or €25 for Private Chef bookings) is charged online at the time of booking. The remainder is paid directly to the Provider on the day of service.

Commission: LocalsOnDemandcharges a fixed €10 fee on all non-chef bookings and a fixed €25 fee on Private Chef bookings. These fees are deducted from the Client's total payment. Providers receive the net amount after the platform fee.

Payouts: Provider payouts are processed via Stripe Connect within 2–5 business days of a completed and confirmed booking.

Client cancellations: Cancellations made more than 48 hours before the scheduled service are eligible for a full refund. Cancellations within 48 hours of the service are non-refundable. The Platform commission is non-refundable in all cases.

Provider cancellations:Providers who cancel confirmed bookings without 24 hours' notice may be subject to account suspension. LocalsOnDemand will make reasonable efforts to assist affected Clients in finding an alternative.

LocalsOnDemand reserves the right to modify this policy and will communicate changes via email.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, or discriminate against other users.
• Submit false or misleading information, including in reviews.
• Circumvent the Platform by arranging bookings or payments outside the system.
• Attempt to access other users' accounts or data.
• Post content that is defamatory, obscene, or infringes third-party rights.

Violations may result in immediate account termination and, where applicable, legal action.

Only Clients who have completed a confirmed booking may leave a review for a Provider. Reviews must be honest and based on the actual experience. LocalsOnDemand reserves the right to remove reviews that violate our content guidelines or are submitted in bad faith.

Reviews are permanent once published except in cases of clear policy violation. Providers may not request removal of negative reviews that comply with these Terms.

As a technical intermediary only, LocalsOnDemand shall not be held liable for any direct or indirect damages arising from the performance, non-performance, quality, or any other aspect of a service provided by a Provider to a Client, including but not limited to personal injury, property damage, financial loss, or loss of data.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOCALSONDEMAND'S TOTAL LIABILITY TO ANY USER FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF THE COMMISSION FEE COLLECTED BY LOCALSONDEMAND IN CONNECTION WITH THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.

LocalsOnDemand expressly disclaims any liability for indirect, incidental, special, consequential, or punitive damages of any kind, even if advised of the possibility of such damages.

In the event of a dispute between a Client and a Provider arising from a booking or the provision of a service, both parties agree to first attempt resolution by good-faith direct negotiation.

LocalsOnDemand is not a party to any such dispute and is under no obligation to act as a mediator. However, LocalsOnDemand reserves the right to suspend or restrict the accounts of any users involved in an unresolved dispute where, in its reasonable judgment, continued platform access may harm other users or the integrity of the Platform.

Any suspension or restriction of accounts is a protective measure only and does not imply any finding of fault or liability on the part of either user.

You agree to indemnify and hold LocalsOnDemand, its officers, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

The Platform and all content created by LocalsOnDemand (including design, logos, text, and software) are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting content (reviews, profile information, photos) you grant LocalsOnDemand a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for the purpose of operating the Platform.

These Terms are governed by and construed in accordance with the laws of Montenegro. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts in Podgorica, Montenegro.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution. Contact us at legal@localsondemand.me to open a dispute. This obligation to seek amicable resolution shall not prevent either party from seeking urgent interim or injunctive relief from a competent court.

LocalsOnDemand reserves the right to update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
